1. Scope and Sources of Data

‍We process the data you provide through the forms on our website, including: your name, email address, date (and optionally time/place) of birth for preparing a horoscope or reading; transactional information; correspondence; and technical data related to your use of the service (such as IP address/device ID, cookies, and event logs).

2) Purposes and legal bases for processing

performance of a contract/provision of digital services (e.g. preparation and delivery of a reading/horoscope by e-mail) – Art. 6(1)(b) GDPR;

legal obligations (settlements, taxes, accounting) – Art. 6(1)(c) GDPR;

statistics, service security, establishment or defense of claims – Art. 6(1)(f) GDPR (legitimate interest);

We do not process special categories of data (Art. 9 GDPR). Data regarding date/time/place of birth are used solely for the preparation of the ordered astrological content and are not used to make decisions producing legal effects.

5) Retention

We store data for the duration of the contract and:

billing data – until the expiration of tax and claim limitation periods (usually up to 5 years from the end of the tax year);

marketing data – until consent is withdrawn;

technical data/logs – for the period necessary to ensure security and service continuity.

Providing your data is voluntary but necessary for the conclusion and performance of the contract (without your email and reading-related data, we will not be able to deliver the content).

1) General Provisions

These Terms set out the rules for using the astroguru.com website, including the conclusion of distance contracts for the provision of digital services, as well as the rights and obligations of Users and the Service Provider.

The Service Provider provides services electronically in accordance with the Act on the Provision of Electronic Services and other applicable provisions of Polish and EU law.

2) Definitions

Service – the website https://www.astrologia.guru/

User/Client – a natural person (including a Consumer or Entrepreneur-Consumer), legal person, or organizational unit using the Service.

Digital Service/Digital Content – the preparation and delivery of a personalized reading/horoscope and related materials in electronic form (e.g., email/file).

3) Type and Scope of Services

Acceptance of orders for readings/horoscopes, delivery of digital content electronically, and an optional newsletter.

Technical requirements: a device with Internet access, an up-to-date web browser, and an active email account.

Content (readings/horoscopes) is prepared based on the data provided by the User and generated using artificial intelligence algorithms. The services are for entertainment and educational purposes only and do not constitute medical, legal, or financial advice.

4) Conclusion and Performance of the Contract

The contract is concluded upon placing an order on the Website and making payment (if required) — confirmation will be sent by email.

Performance consists of preparing the content based on the data provided by the Client and delivering it to the specified email address within the declared timeframe (informational timeframe).

For personalized services, performance may begin before the 14-day withdrawal period expires, only with your explicit consent and confirmation of the loss of the right of withdrawal — the relevant statements are presented during the ordering process (checkboxes). This exception arises from the Consumer Rights Act implementing the EU Digital Directives.

5) Prices and Payments

The prices listed on the Website are gross amounts in PLN (unless expressly stated otherwise).

Available payment methods: instant electronic payments or card payments via Stripe Payments Europe, Limited.

Stripe may process the Client’s personal data necessary to complete the payment in accordance with its Privacy Policy: https://stripe.com/pl/privacy.

An invoice is issued upon request.

6) Right of Withdrawal (Consumers)

As a rule, you have 14 days to withdraw from a distance contract without giving any reason.

Exception: if you have given consent for the provision of a paid service to begin before the expiry of the 14-day period and have been informed of the loss of the right of withdrawal — the right of withdrawal does not apply once the service has been fully performed. (Article 38 of the Consumer Rights Act).

7) Non-Compliance of Digital Content/Service with the Contract – Complaints

We are responsible for the conformity of digital content/services with the contract in accordance with the chapters added in 2023 to the Consumer Rights Act (implementing Directives 2019/770 and 2019/771).

The content and materials provided as part of the services are protected by copyright law.

You receive a non-exclusive, non-transferable license for personal, non-commercial use. Further distribution, resale, or publication without our consent is prohibited.

12) Changes to the Terms of Service

We may amend these Terms for valid reasons (e.g., changes in law, functionality, or payment methods). You will be informed of any changes in advance; contracts concluded before the amendment remain subject to the previous version unless you agree to the new one.

13) Governing Law and Jurisdiction

Contracts with Consumers are governed by Polish law and the relevant provisions of EU law, with respect for the mandatory consumer protection rules of the country of the consumer’s habitual residence. Disputes may be resolved by the competent common courts in accordance with applicable regulations.
